Purchase of a Home or other Real Estate:

In Nicaragua, the Purchase/Sales Contract is in itself the deed to the property. It includes items such as: the legal description of the property, the results of the search and examination performed at the Recorder’s Office, the results of the survey, the property taxes owed, or a declaration stating there are no taxes owed on the property, and any accessory items, such as a mortgage or a leasehold clause (usufructo). As per Nicaraguan law, the contract must be drafted by a lawyer/notary; therefore, contracts not drafted by a lawyer/notary cannot be recorded and are not considered a valid deed to the property. 

Title Insurance:

Investing in Nicaragua can be a highly lucrative endeavor if the buyer takes the necessary steps to buy a property free of clouds on the title. Title Insurance is available in Nicaragua, although not on all properties. Because of the widespread confiscations that took place during the 80’s, many properties have dubious chains of title. This highlights the importance of title insurance in Nicaragua.

Title insurance is available through several well-established Title Insurance Companies headquartered in the United States. Bendaña & Bendaña has been approved with many of these firms, allowing us to provide comprehensive legal advice and services to both foreigners and locals in the purchase of real estate in Nicaragua.

What is title insurance?

Title insurance indemnifies the lender and buyer against any loss that may result from defects in the title to the property or claims against the property, if any of these were not uncovered in the title search and examination. The title policy is issued after the title to the property has been searched and examined.
